1. Allmänt

1.1 Fullmaktskollen i Sverige AB ägs av Svensk Försäkring och Svenska försäkringsförmedlares förening och har bildats i samverkan med Pensionsmyndigheten. Bolagets uppdrag är att utan vinstintresse utveckla, förvalta och sköta den dagliga driften av fullmaktskollen.se. Syftet med fullmaktskollen.se är att inom området för liv- och pensionsförsäkring ge dig som lämnar fullmakter överblick och kontroll. Samtidigt blir hanteringen av fullmakter effektivare och säkrare.

1.2 Genom att använda fullmaktskollen.se kan du som lämnar fullmakt på ett enkelt och överskådligt sätt skriva under fullmakter så att de som ska använda dem får tillgång till den direkt se vilka fullmakter som du har lämnat återkalla fullmakter och ändra deras giltighetstid.

1.3 Genom att registrera dig på fullmaktskollen.se godkänner du som fullmaktsgivare dessa användarvillkor och förbinder dig att följa dem.

 

2. Logga in på fullmaktskollen.se

2.1 För att kunna se och administrera dina fullmakter på fullmaktskollen.se loggar du in med e-legitimation.

 

3. Det här kan du göra på fullmaktskollen.se

3.1 I inställningarna på fullmaktskollen.se anger du din e-postadress eller ditt mobilnummer. Du kommer att få meddelanden från fullmaktskollen.se via e-post eller sms. Fullmaktskollen.se ansvarar inte för att meddelandena når fram till dig.

3.2 Du kan skriva under, återkalla och ändra giltighetstid för dina fullmakter. Det gäller både fullmakter som du har lagt upp direkt på fullmaktskollen.se och fullmakter som du har skrivit under på papper och som den som du har gett fullmakten sedan har registrerat på fullmaktskollen.se.

3.3 Den som du ger fullmakt lägger upp din fullmakt i registret och kan se om du har skrivit under den. En underskriven fullmakt kommer också att visas elektroniskt för försäkringsbolag och andra aktörer som du är eller är på väg att bli kund hos. Den som du ger fullmakt anger vilka som kan se din fullmakt.

3.4 Den som du har gett fullmakt kan meddela Fullmaktskollen i Sverige AB att fullmakten inte längre gäller. Det kan t.ex. handla om att du har gett någon ett uppdrag som nu är slutfört. Då får du ett meddelande om att fullmakten inte längre gäller.

 

4. Så behandlar fullmaktskollen.se dina personuppgifter

4.1 Fullmaktskollen i Sverige AB behandlar dina personuppgifter, ditt namn, ditt personnummer, din e-postadress och ditt mobilnummer på www.fullmaktskollen.se. Fullmaktskollen behandlar också de personuppgifter som framgår i dina fullmakter. Fullmaktskollen i Sverige AB är personuppgiftsansvarig för de personuppgifter som du lämnar när du registrerar dig på fullmaktskollen.se, till exempel dina kontaktuppgifter. Samma sak gäller personuppgifter som företag och organisationer anslutna till fullmaktskollen.se har lämnat till Fullmaktskollen i Sverige AB. För de personuppgifter som används i fullmakter och återkallelser är fullmaktshavaren personuppgiftsansvarig. Det innebär att när Fullmaktskollen använder dina personuppgifter i fullmakter och återkallelser så är det på uppdrag av den som är personuppgiftsansvarig. All behandling av dina personuppgifter sker i enlighet med gällande lagstiftning. Syftet med behandlingen är att kunna tillhandahålla tjänsten. Överföring av personuppgifter kan komma att ske till de aktörer inom liv- och pensionsområdet som är anslutna till fullmaktskollen.se genom avtal och till Fullmaktskollen i Sverige AB:s underleverantörer för att kunna upprätthålla drift av tjänsten.

5. Friskrivning och skadestånd

5.1 Du ska normalt kunna använda fullmaktskollen.se dygnet runt, sju dagar i veckan. Fullmaktskollen i Sverige AB ansvarar dock inte för eventuella avbrott.

5.2 Aktörer inom liv- och pensionsområdet som vill ansluta sig till fullmaktskollen.se förbinder sig i avtal att följa de krav och villkor som Fullmaktskollen i Sverige AB har ställt upp. Fullmaktskollen i Sverige AB ansvarar för att följa upp att kraven och villkoren följs.

5.3 Fullmaktskollen i Sverige AB ansvarar inte för några direkta eller indirekta skador eller förluster som du som lämnar fullmakt kan råka ut för i anslutning till eller på grund av att du använder fullmaktskollen.se.

5.4 Fullmaktskollen i Sverige AB ansvarar inte för skador eller problem som kan drabba dig som använder fullmaktskollen.se och som beror på driftavbrott eller andra störningar i telefoner, datorer eller någon annan kommunikation.

5.5 Fullmaktskollen i Sverige AB tar inte ansvar för fel eller problem som har att göra med e-legitimation eller motsvarande som du har fått via någon utomstående part.

5.6 Länkar från fullmaktskollen.se till andra webbplatser är en ren informationsservice. Fullmaktskollen i Sverige AB tar inget ansvar för material eller information på dessa webbplatser.

5.7 Fullmaktskollen i Sverige AB:s skadeståndsansvar mot dig som lämnar fullmakt på Fullmaktskollen.se är begränsat till skador som Fullmaktskollen i Sverige AB vållar dig genom att bryta mot någon bestämmelse i dessa användarvillkor eller mot de lagar och författningar som gäller. Fullmaktskollen i Sverige AB ansvarar inte för skador som beror på avbrott i tjänstens tillgänglighet.

5.8 Fullmaktskollen i Sverige AB:s skadeståndsansvar mot dig som lämnar fullmakt på fullmaktskollen.se är begränsat till direkta skador och till ett sammanlagt belopp på en fjärdedels prisbasbelopp enligt Socialförsäkringsbalken (2010:110). Fullmaktskollen i Sverige AB ansvarar inte för indirekta skador, till exempel utebliven vinst eller förlust av information.

 

6. Ditt ansvar som fullmaktsgivare

6.1 För att du ska kunna använda fullmaktskollen.se behöver du tjänster från andra aktörer, till exempel e-post, internet och mobiltelefoni. Du ansvarar för att du har tillgång till dessa tjänster.

6.2 Du ansvarar för att registrera din e-postadress eller ditt mobilnummer på fullmaktskollen.se och att se till att uppgifterna är uppdaterade. Det är dit vi kommer att skicka all information om dina fullmakter.

6.3 Du ansvarar för den information som du lämnar när du registrerar dig på och använder fullmaktskollen.se. Fullmaktskollen i Sverige AB ansvarar inte för konsekvenser som orsakats av att du lämnar felaktig information.

6.4 Du får bara använda fullmaktskollen.se enligt dessa användarvillkor och de författningar och myndighetsbeslut som gäller. Du är också skyldig att följa instruktioner om fullmaktskollen.se som Fullmaktskollen i Sverige AB meddelar dig via e-post eller sms.

6.5 Du ska skydda din e-legitimation på ett betryggande sätt. Fullmaktskollen i Sverige AB ansvarar inte för konsekvenser som orsakas om någon obehörigen använder din e-legitimation.

 

7. Andra aktörers ansvar

7.1 Aktörer inom liv- och pensionsområdet som är anslutna till fullmaktskollen.se ansvarar för att följa de krav och villkor som står i avtalet mellan Fullmaktskollen i Sverige AB och respektive aktör.

 

8. Rättigheter kopplade till fullmaktskollen.se

8.1 Samtliga rättigheter kopplade till fullmaktskollen.se tillhör Fullmaktskollen i Sverige AB. Genom att registrera dig på fullmaktskollen.se har du rätt att använda de tjänster som finns på fullmaktskollen.se enligt dessa användarvillkor.

 

9. Avregistrera dig från fullmaktskollen.se

9.1 Du kan när som helst avregistrera dig från fullmaktskollen.se. Det kan du göra genom att logga in på fullmaktskollen.se. Om du vill avregistrera dig behöver du först återkalla alla gällande fullmakter som du har lämnat.

 

10. Drift och underhåll

10.1 Fullmaktskollen i Sverige AB har rätt att begränsa tillgängligheten till fullmaktskollen.se på grund av utveckling, underhåll eller av driftmässiga skäl. Fullmaktskollen i Sverige AB ska sträva efter att minimera avbrottstiden och vidta åtgärder för att du som lämnar fullmakter och alla andra anslutna aktörer ska vållas minsta möjliga skada. Fullmaktskollen i Sverige AB ska så långt det är möjligt informera dig och andra anslutna aktörer om planerade avbrott.

 

11. Ändringar i fullmaktskollen.se

11.1 Fullmaktskollen i Sverige AB har rätt att göra ändringar på fullmaktskollen.se. Information om ändringar lämnas på webbplatsen www.fullmaktskollen.se.

 

12. Avveckling av fullmaktskollen.se

12.1 Fullmaktskollen i Sverige AB får avveckla fullmaktskollen.se helt eller delvis. I så fall ska du som lämnar fullmakt och alla andra aktörer underrättas i god tid, minst två månader före avvecklingen.

 

13. Tillägg och ändringar av användarvillkoren

13.1 Fullmaktskollen i Sverige AB har rätt att göra tillägg och ändringar i dessa användarvillkor. Fullmaktskollen i Sverige AB ska underrätta dig som lämnar fullmakt om sådana tillägg och ändringar via den e-postadress eller det mobilnummer som du har registrerat. Om ändringarna är av begränsad betydelse behöver vi dock inte underrätta dig.

 

14. Aktuella lagar gäller

14.1 Dessa användarvillkor ska tolkas och tillämpas enligt svensk rätt.

1. Allmänt

Bolagets uppdrag är att utan vinstintresse utveckla, förvalta och sköta den dagliga driften av en digital fullmaktstjänst, fullmaktskollen.se. Syftet med fullmaktskollen.se är att ge privatpersoner och arbetsgivare som lämnar fullmakter inom liv- och pensionsområdet överblick och kontroll. Samtidigt blir hanteringen av fullmakter effektivare och säkrare.

1.2 Genom att använda fullmaktskollen.se kan den som lämnar fullmakt på ett enkelt och överskådligt sätt skriva under fullmakter så att de som ska använda dem får tillgång till dem direkt se vilka fullmakter som har lämnats återkalla fullmakter och ändra deras giltighetstid.

 

1.3 Genom att registrera organisationen på fullmaktskollen.se godkänner organisationen dessa användarvillkor och förbinder sig att följa dem.

 

2. Registrering av organisationen

2.1 En firmatecknare eller någon annan behörig företrädare, vilket innebär en person som från firmatecknaren fått i uppdrag att ställa ut en fullmakt för organisationen inom liv- och pensionsområdet, ska bekräfta registreringen av organisationen på fullmaktskollen.se. Bekräftelsen kan ske så snart en fullmaktshavare har lagt upp en fullmakt för underskrift för den aktuella organisationen. Underskrift ska alltid ske av den firmatecknare eller annan behörig företrädare som fullmaktshavaren har angivit i fullmakten. Det är bara fullmaktshavare som har ett anslutningsavtal med Fullmaktskollen i Sverige AB som kan lägga upp fullmakter för registrering på fullmaktskollen.se. Fullmaktskollen i Sverige AB gör inga behörighetskontroller på den person eller de personer som angivits som firmatecknare eller annan behörig företrädare eller på de personer, nedan kallade ”användare”, som tilldelas behörighet enlig nedan.

2.2 En organisation får bara använda fullmaktskollen.se enligt dessa användarvillkor och instruktioner meddelade av Fullmaktskollen i Sverige AB.

2.3 Vid registrering och användning av tjänsterna på fullmaktskollen.se krävs att användaren loggar in med e-legitimation.

 

3. Tilldelning av behörighet

3.1 Tilldelning av behörighet sker i samband med registrering och kan därefter löpande justeras enligt nedan. Behörighet för användare kan registreras i tre nivåer:

– företrädare (firmatecknare eller annan behörig företrädare)

– huvudadministratör

– administratör.

3.2 Användarna har följande behörigheter:

En företrädare är behörig att

– underteckna ny fullmakt

– återkalla fullmakt

– ändra giltighetstid för fullmakt

– ange begränsningar för vilka personer som fullmakten ska omfatta

– avsluta registrering på fullmaktskollen.se

– ändra egna notifieringar

– lägga till nya användare eller ta bort registrerade användare.

En huvudadministratör är behörig att

– återkalla fullmakt

– ändra giltighetstid för fullmakt

– ange begränsningar för vilka personer som fullmakten ska omfatta

– ändra egna notifieringar

– lägga till nya användare eller ta bort registrerade användare.

En administratör är behörig att

– lägga till och ta bort personer på en registrerad fullmakt

– ändra egna notifieringar.

3.3 Vid registrering av en användare eller förändring av en användares behörighet krävs att användaren loggar in med sin e-legitimation och bekräftar den aktuella behörigheten. För att underteckna en ny fullmakt krävs alltid att den fullmaktshavare som lagt upp den aktuella fullmakten för undertecknande anger vem som är aktuell företrädare. Endast den företrädare som finns angiven i fullmakten kan skriva under den aktuella fullmakten.

 

4. Registrering av fullmakter

4.1 En fullmakt kan registreras hos Fullmaktskollen i Sverige AB på två sätt:

a) En företrädare för organisationen skriver under en digital fullmakt som en fullmaktshavare har lagt upp för den aktuella organisationen att undertecknas av den namngivne företrädaren. Underskriften ska göras med e-legitimation.

b) En firmatecknare eller någon annan behörig företrädare för organisationen skriver under en standardiserad pappersfullmakt som Fullmaktskollen i Sverige AB har tagit fram. Fullmakten skannas sedan och registreras på fullmaktskollen.se.

 

5 Meddelanden

5.1 Meddelanden från fullmaktskollen.se skickas till organisationens registrerade användare via e-post eller sms. Användaren anger i inställningarna vilka meddelanden som ska skickas till användaren och ansvarar själv för att kontaktuppgifter och meddelandeinställningar är uppdaterade. Kontaktuppgifter och inställningar uppdateras under Mina inställningar. Meddelandena kan handla om att det finns en ny fullmakt att skriva under eller att det har skett förändringar i befintliga gällande fullmakter.

 

6. Personuppgiftsbehandling

6.1 Fullmaktskollen i Sverige AB behandlar dina personuppgifter, ditt namn, ditt personnummer, din e-postadress och ditt mobilnummer på fullmaktskollen.se. Fullmaktskollen behandlar också de personuppgifter som framgår i dina fullmakter.

Fullmaktskollen i Sverige AB är personuppgiftsansvarig för de personuppgifter som du lämnar när du registrerar dig på fullmaktskollen.se, till exempel dina kontaktuppgifter. Samma sak gäller personuppgifter som företag och organisationer anslutna till fullmaktskollen.se har lämnat till Fullmaktskollen i Sverige AB.

För de personuppgifter som används i fullmakter och återkallelser är fullmaktshavaren personuppgiftsansvarig. Det innebär att när Fullmaktskollen använder dina personuppgifter i fullmakter och återkallelser så är det på uppdrag av den som är personuppgiftsansvarig.

All behandling av dina personuppgifter sker i enlighet med gällande lagstiftning. Syftet med behandlingen är att kunna tillhandahålla tjänsten. Överföring av personuppgifter kan komma att ske till de aktörer inom liv- och pensionsområdet som är anslutna till fullmaktskollen.se genom avtal och till Fullmaktskollen i Sverige AB:s underleverantörer för att kunna upprätthålla drift av tjänsten.

7. Ansvarsfriskrivning

7.1 Fullmaktskollen.se ska normalt vara tillgänglig dygnet runt, sju dagar i veckan. Fullmaktskollen i Sverige AB ansvarar dock inte för eventuella driftsstörningar eller avbrott.

7.2 Fullmaktskollen i Sverige AB ansvarar inte heller för fel eller skador som beror på att meddelanden inte kommer fram eller inte kommer fram i tid eller fel eller skador som uppstår på grund av att organisationen, andra uppdragsgivare anslutna till fullmaktskollen.se eller tredje man lämnar felaktig eller försenad information.

7.3 Fullmaktskollen i Sverige AB ansvarar inte för skador eller problem som kan drabba en organisation som använder fullmaktskollen.se och som beror på driftavbrott eller andra störningar i telefoner, datorer eller någon annan kommunikation.

7.4 Länkar från fullmaktskollen.se till andra webbplatser är en ren informationsservice. Fullmaktskollen i Sverige AB ansvarar inte för material eller information på dessa webbplatser.

7.5 Fullmaktskollen i Sverige AB:s skadeståndsansvar är begränsat till skador som Fullmaktskollen i Sverige AB av vårdslöshet vållar en organisation genom att bryta mot dessa användarvillkor eller mot gällande lagar och förordningar. Fullmaktskollen i Sverige AB ansvarar inte i något fall för skador som beror på avbrott i tjänstens tillgänglighet eller om någon obehörig utnyttjar tjänsterna på fullmaktskollen.se, förutom om Fullmaktskollen i Sverige AB har handlat grovt vårdslöst.

7.6 Fullmaktskollen i Sverige AB:s skadeståndsansvar är under alla förhållanden begränsat till direkta skador och till ett sammanlagt belopp på en fjärdedels prisbasbelopp enligt socialförsäkringsbalken (2010:110). 8. Rättigheter kopplade till fullmaktskollen.se

8.1 Samtliga rättigheter kopplade till fullmaktskollen.se tillhör Fullmaktskollen i Sverige AB. Genom att registrera en organisation på fullmaktskollen.se har organisationen rätt att använda de tjänster som finns på fullmaktskollen.se enligt dessa användarvillkor.

 

9. Avregistrering från fullmaktskollen.se

9.1 En firmatecknare eller någon annan behörig företrädare för organisationen kan när som helst avregistrera organisationen från fullmaktskollen.se genom att logga in på fullmaktskollen.se. Vid avregistrering ska alla gällande fullmakter för organisationen som registrerats via fullmaktskollen.se återkallas av företrädare eller huvudadministratör. Ett meddelande om genomförd avregistrering kommer att skickas till organisationens samtliga registrerade användare.

 

10. Drift och underhåll

10.1 Fullmaktskollen i Sverige AB har rätt att begränsa tillgängligheten till fullmaktskollen.se på grund av utveckling, underhåll eller av driftmässiga skäl. Fullmaktskollen i Sverige AB ska sträva efter att minimera avbrottstiden och vidta åtgärder för att de som lämnar fullmakter och Fullmaktskollen i Sverige AB:s uppdragsgivare ska vållas minsta möjliga skada. Fullmaktskollen i Sverige AB ska så långt det är möjligt informera organisationen och uppdragsgivare om planerade avbrott.

 

11 Ändringar av tjänsterna i fullmaktskollen.se

11.1 Fullmaktskollen i Sverige AB har rätt att göra ändringar av tjänsterna på fullmaktskollen.se. Information om ändringar lämnas på webbplatsen www.fullmaktskollen.se.

 

12 Avveckling av fullmaktskollen.se

12.1 Fullmaktskollen i Sverige AB får avveckla fullmaktskollen.se helt eller delvis. I så fall ska användarna underrättas i god tid, minst två månader före avvecklingen.

 

13. Tillägg och ändringar av användarvillkoren

13.1 Fullmaktskollen i Sverige AB har rätt att göra tillägg och ändringar i dessa användarvillkor. Fullmaktskollen i Sverige AB ska genom meddelande underrätta administratörer om sådana tillägg och ändringar. Om ändringarna är av begränsad betydelse behöver Fullmaktskollen i Sverige AB dock inte skicka något meddelande.

 

14. Tillämplig lag

14.1 Dessa användarvillkor ska tolkas och tillämpas enligt svensk rätt.

1. Generally

1.1 Fullmaktskollen i Sverige AB is owned by Insurance Sweden and the Swedish Insurance Brokers’ Association and has been formed in cooperation with the Swedish Pensions Agency. The mission of the company is to develop, administer and manage the daily operation of fullmaktskollen.se on a non-for-profit basis. The purpose of fullmaktskollen.se is, within the area of life and pension insurance, to provide an overview and control to those of you who grant powers of attorney. At the same time, administering powers of attorney is made more efficient and secure.

1.2 By using fullmaktskollen.se, those of you who grant powers of attorney can simply and easily:

• sign powers of attorney so that persons who are going to use them obtain immediate access to them;
• see which powers of attorney you have granted;
• revoke powers of attorney and change the period of time during which they are valid.

1.3 As the grantor, you approve these User Terms and Conditions and undertake to comply with them by registering with fullmaktskollen.se.

 

2. Log on to fullmaktskollen.se

2.1 In order to view and administer your powers of attorney at fullmaktskollen.se, log on with your Swedish digital ID.

 

3. What you can do on fullmaktskollen.se

3.1 In the settings on fullmaktskollen.se, you provide your e-mail address or your mobile telephone number. You will receive messages from fullmaktskollen.se via e-mail or SMS. Fullmaktskollen.se is not responsible for ensuring that these messages reach you.

3.2 You can sign, revoke and change the period of validity of your powers of attorney. The aforementioned applies both to powers of attorney which you have uploaded directly on fullmaktskollen.se and paper versions of powers of attorney which you have signed and which have been registered on fullmaktskollen.se by the organisation you have authorised with the power of attorney (the “agent”).

3.3 The agent to whom you have granted a power of attorney posts your power of attorney in the register and can see if you have signed it. A signed power of attorney will also be displayed electronically for insurance companies and other parties of whom you are, or are in the process of becoming, a customer. The person to whom you have granted the power of attorney states who can view your power of attorney.

3.4 The agent to whom you have granted a power of attorney may notify Fullmaktskollen i Sverige AB that the power of attorney is no longer valid. This might happen, for example, when someone you have engaged has concluded their assignment. You will then receive a message that the power of attorney no longer applies.

 

4. How Fullmaktskollen.se processes your personal data

4.1 Fullmaktskollen i Sverige AB processes your personal data, your name, your personal identification number, your e-mail address and your mobile telephone number on fullmaktskollen.se. Fullmaktskollen also processes the personal data stated in your powers of attorney.

Fullmaktskollen i Sverige AB is the data controller for the personal data provided by you when you registered with fullmaktskollen.se, e.g. your contact information. The same also applies to personal data provided to Fullmaktskollen i Sverige AB by companies and organisations connected to fullmaktskollen.se.

The agent is the personal data controller for the personal data which is used in powers of attorney and revocations. This means that, when Fullmaktskollen uses your personal data in powers of attorney and revocations, it is on behalf of the agent who is the personal data controller.

All processing of personal data takes place in accordance with applicable legislation. The purpose of processing is to be able to provide the service. 5. Disclaimer and damages

5.1 Normally, you shall be able to use fullmaktskollen.se 24 hours a day, 7 days a week. However, Fullmaktskollen i Sverige AB shall not be liable for any outages.

5.2 Organisations in the life insurance and pensions area who wish to connect to fullmaktskollen.se are contractually bound to comply with the requirements and terms and conditions established by Fullmaktskollen i Sverige AB. Fullmaktskollen i Sverige AB shall be responsible for following up on compliance with the requirements and terms and conditions.

5.3 Fullmaktskollen i Sverige AB shall not be liable for any direct or indirect damage or loss which those of you who grant powers of attorney may incur in connection with, or due to, your use of fullmaktskollen.se.

5.4 Fullmaktskollen i Sverige AB shall not be liable for damage or problems which may affect those of you who use fullmaktskollen.se and which are due to operational outages or other disruptions to telephones, computers or other communications.

5.5 Fullmaktskollen i Sverige AB shall not be liable for faults or problems relating to digital identification or similar which you have received from third parties.

5.6 Links from fullmaktskollen.se to other websites constitute nothing more than an information service. Fullmaktskollen i Sverige AB is not responsible for the material or information on such websites.

5.7 Fullmaktskollen i Sverige AB’s liability in damages to those of you who grant powers of attorney on fullmaktskollen.se shall be limited to damage which Fullmaktskollen i Sverige AB causes to you by breaching any provision of these User Terms and Conditions or applicable laws and statutes. Fullmaktskollen i Sverige AB shall not be liable for damage due to disruptions in the availability of the service.

5.8 Fullmaktskollen i Sverige AB’s liability in damages to those of you who grant powers of attorney on fullmaktskollen.se shall be limited to direct damage and to an aggregate amount of one-fourth of a statutory price base amount in accordance with the Swedish Social Insurance Code (Swedish Code of Statutes 2010:110). Fullmaktskollen i Sverige AB shall not be liable for indirect damage, e.g. loss of profit or loss of information.

 

6. Your liability as a grantor

6.1 In order for you to be able to use fullmaktskollen.se, you need services from other providers, e.g. e-mail, internet and mobile telephony services. You shall be responsible for ensuring that you have access to these services.

6.2 You are responsible for registering your e-mail address or your mobile telephone number on fullmaktskollen.se and to ensure that the information is updated. It is you to whom we shall send all information regarding your powers of attorney.

6.3 You shall be responsible for the information you provide when you register on and use fullmaktskollen.se. Fullmaktskollen i Sverige AB is not responsible for any consequences of your provision of incorrect information.

6.4 You may only use fullmaktskollen.se in accordance with these User Terms and Conditions and applicable statutes and decisions by governmental authorities. You shall also be obliged to comply with the instructions regarding fullmaktskollen.se provided to you by Fullmaktskollen i Sverige AB via e-mail or SMS.

6.5 You must store your Swedish digital ID in a secure manner. Fullmaktskollen i Sverige AB shall not be liable for the consequences resulting from use of your Swedish digital ID by an unauthorised party.

7. Responsibilities of other organisations

7.1 Organisations within the area of life and pension insurance who are connected to fullmaktskollen.se shall be responsible for complying with the requirements and terms and conditions set forth in the agreement between Fullmaktskollen i Sverige AB and the respective organisation.

 

8. Rights connected to fullmaktskollen.se

8.1 All rights connected to fullmaktskollen.se belong to Fullmaktskollen i Sverige AB. By registering on fullmaktskollen.se, you are entitled to use the services on fullmaktskollen.se in accordance with these User Terms and Conditions.

 

9. Unregister from fullmaktskollen.se

9.1 You may unregister from fullmaktskollen.se at any time. You may do so by logging on to fullmaktskollen.se. If you wish to unregister, you must first revoke all applicable powers of attorney you have granted.

 

10. Operation and maintenance

10.1 Fullmaktskollen i Sverige AB shall be entitled to limit access to fullmaktskollen.se due to development work, maintenance or for operational reasons. Fullmaktskollen i Sverige AB shall strive to minimise downtime and to take measures to mitigate to the extent possible the damage incurred by those of you who grant powers of attorney and all other connected parties. To the extent possible, Fullmaktskollen i Sverige AB shall inform you and other connected parties regarding planned outages.

 

11. Changes to fullmaktskollen.se

11.1 Fullmaktskollen i Sverige AB shall be entitled to implement changes to fullmaktskollen.se. Information regarding changes shall be provided on www.fullmaktskollen.se

 

12. Winding up of fullmaktskollen.se

12.1 Fullmaktskollen i Sverige AB may wind up fullmaktskollen.se in whole or in part. In such cases, those of you who grant powers of attorney and other parties shall be notified in ample time, not later than two months prior to winding up.

 

13. Supplements and amendments to the User Terms and Conditions

13.1 Fullmaktskollen i Sverige AB shall be entitled to implement supplements and amendments to these terms and conditions. Fullmaktskollen i Sverige AB shall notify those of you who grant powers of attorney regarding such supplements and amendments via the e-mail address or the mobile telephone number you have registered. In the event the amendments are minor, however, we shall not be required to notify you.

 

14 Relevant laws apply

14.1 These User Terms and Conditions shall be interpreted and applied in accordance with Swedish law.

1. Generally

1.1 Fullmaktskollen i Sverige AB is owned by Insurance Sweden and the Swedish Insurance Brokers’ Association and has been formed in cooperation with the Swedish Pensions Agency. The mission of the company is to develop, administer and manage the daily operation of fullmaktskollen.se on a non-for-profit basis. The purpose of fullmaktskollen.se is, within the area of life and pension insurance, to provide an overview and control to individuals and employers who grant powers of attorney. At the same time, administering powers of attorney is made more efficient and secure.

1.2 By using fullmaktskollen.se, those of you who grant powers of attorney can simply and easily:

• sign powers of attorney so that persons who are going to use them obtain immediate access to them;
• see which powers of attorney have been granted;
• revoke powers of attorney and change the period of time during which they are valid.

1.3 The organisation approves these User Terms and Conditions and undertakes to comply with them by registering the organisation with fullmaktskollen.se.

 

2. Registration of the organisation

2.1 A company signatory or other authorised representative, i.e. a person who has been instructed by the company signatory to issue a power of attorney on behalf of the organisation within the area of life and pension insurance, shall confirm registration of the organisation on fullmaktskollen.se. Confirmation can be given as soon as an agent has uploaded a power of attorney for signature for the relevant organisation. The signature must at all times be that of the company’s signatory or other authorised representative set forth in the power of attorney by the agent. It is only the agent who has a connection agreement with Fullmaktskollen i Sverige AB who can post powers of attorney for registration on fullmaktskollen.se. Fullmaktskollen i Sverige AB shall not conduct any authorisation verifications regarding the person or persons who have been identified as company signatories or other authorised representative or of the persons, hereinafter referred to as ”users”, who have been allocated authorisation in accordance with the provisions below.

2.2 An organisation may only use fullmaktskollen.se in accordance with these User Terms and Conditions and instructions issued by Fullmaktskollen i Sverige AB.

2.3 In conjunction with registration and use of the services on fullmaktskollen.se, the user must log on with a Swedish digital ID.

 

3. Allocation of authorisation

3.1 Authorisation is allocated in conjunction with registration and may thereafter be regularly adjusted as set forth below. User authorisation may be registered on three levels:

– representative (company signatory or other authorised representative)

– head administrator

– administrator

3.2 Users shall have the following powers:

A representative is authorised to:

– sign a new power of attorney

– revoke a power of attorney

– change the period of validity of a power of attorney

– state limitations for which individuals are covered by the power of attorney

– terminate registration on fullmaktskollen.se

– change how they themselves receive notifications

– add new users or remove registered users

A head administrator is authorised to:

– revoke a power of attorney

– change the period of validity of a power of attorney

– state limitations for which individuals are covered by the power of attorney

– change how they themselves receive notifications

– add new users or remove registered users

An administrator is authorised to:

– add persons to, and remove persons from, a registered power of attorney

– change how they themselves receive notifications

3.3 In conjunction with registration of a user or a change of a user’s authorisation, the user must log on with their Swedish digital ID and confirm the relevant authority. In order to sign a new power of attorney, it is at all times required that the agent who posted the relevant power of attorney for signature provides the name of the relevant representative. Only the representative set forth in the power of attorney may sign the relevant power of attorney.

 

4. Registration of powers of attorney

4.1 A power of attorney may be registered with Fullmaktskollen i Sverige AB in two ways:

a) A representative of the organisation signs a digital power of attorney which the agent has posted for the relevant organisation to be signed by the named representative. It is to be signed with a Swedish digital ID.

b) A signatory or other authorised representative of the organisation signs a standardised paper version of a power of attorney produced by Fullmaktskollen i Sverige AB. The power of attorney is subsequently scanned and registered on fullmaktskollen.se.

 

5. Communications

5.1 Communications from fullmaktskollen.se are sent to the organisation’s registered user via e-mail or SMS. In the settings, the user indicates which messages are to be sent to the user and is responsible for ensuring that contact information and communication settings are updated. The contact information and settings are updated under Mina inställningar (currently in Swedish only). Communications may relate to new powers of attorney to be signed or changes to existing, applicable powers of attorney.

 

6. Processing of personal data

6.1 Fullmaktskollen i Sverige AB processes your personal data, your name, your personal identification number, your e-mail address and your mobile telephone number on fullmaktskollen.se. Fullmaktskollen also processes the personal data stated in your powers of attorney.

Fullmaktskollen i Sverige AB is the data controller for the personal data provided by you when you registered with fullmaktskollen.se, e.g. your contact information. The same also applies to personal data provided to Fullmaktskollen i Sverige AB by companies and organisations connected to fullmaktskollen.se.

The agent is the personal data controller for the personal data which is used in powers of attorney and revocations. This means that, when Fullmaktskollen uses your personal data in powers of attorney and revocations, it is on behalf of the person who is the personal data controller.

All processing of personal data takes place in accordance with applicable legislation. The purpose of processing is to be able to provide the service. Personal data may be transferred to organisations within the area of life and pension insurance who are connected to fullmaktskollen.se by virtue of an agreement, and to Fullmaktskollen i Sverige AB’s subcontractors in order to be able to maintain operation of the service.

7. Disclaimer of liability

7.1 Normally, you shall be able to use fullmaktskollen.se 24 hours a day, 7 days a week. However, Fullmaktskollen i Sverige AB shall not be liable for any operational disruptions or outages.

7.2 In addition, Fullmaktskollen i Sverige AB is not liable for faults or damage resulting from the fact that a communication has not been received or is not received on time or for faults or damage which is incurred as a consequence of the fact that the organisation, other principals connected to fullmaktskollen.se, or third parties provide incorrect or delayed information.

7.3 Fullmaktskollen i Sverige AB shall not be liable for damage or problems which may affect an organisation which uses fullmaktskollen.se and which are due to operational outages or other disruptions to telephones, computers or other communications.

7.4 Links from fullmaktskollen.se to other websites constitute nothing more than an information service. Fullmaktskollen i Sverige AB is not responsible for the material or information on such websites.

7.5 Fullmaktskollen i Sverige AB’s liability in damages shall be limited to damage which Fullmaktskollen i Sverige AB negligently causes to an organisation by breaching any provision of these User Terms and Conditions or applicable laws and statutes. Fullmaktskollen i Sverige AB shall not be liable under any circumstances for damage due to disruptions in the availability of the service or where any unauthorised individual uses the fullmaktskollen.se service except where Fullmaktskollen i Sverige AB has acted with gross negligence.

7.6 Fullmaktskollen i Sverige AB’s liability in damages shall be limited in any event to direct damage and to an aggregate amount of one-fourth of a statutory price base amount in accordance with the Swedish Social Insurance Code (Swedish Code of Statutes 2010:110). Fullmaktskollen i Sverige AB shall not be liable for indirect damage, e.g. loss of profit or loss of information.

 

8. Rights connected to fullmaktskollen.se

8.1 All rights connected to fullmaktskollen.se belong to Fullmaktskollen i Sverige AB. By registering an organisation on fullmaktskollen.se, the organisation is entitled to use the services on fullmaktskollen.se in accordance with these User Terms and Conditions.

 

9. Unregister from fullmaktskollen.se

9.1 A company signatory or other authorised representative of the organisation may at any time unregister the organisation from fullmaktskollen.se by logging onto fullmaktskollen.se. In conjunction with deregistration, all applicable powers of attorney for the organisation which have been registered via fullmaktskollen.se will be revoked by a representative or head administrator. A notice of deregistration will be sent to all of the organisation’s registered users.

 

10. Operation and maintenance

10.1 Fullmaktskollen i Sverige AB shall be entitled to limit access to fullmaktskollen.se due to development work, maintenance or for operational reasons. Fullmaktskollen i Sverige AB shall strive to minimise downtime and to take measures to mitigate to the extent possible the damage incurred by parties who grant powers of attorney and Fullmaktskollen i Sverige AB’s principals. To the extent possible, Fullmaktskollen i Sverige AB shall inform the organisation and principals regarding planned outages.

 

11. Changes to the services in fullmaktskollen.se

11.1 Fullmaktskollen i Sverige AB shall be entitled to implement changes to the services in fullmaktskollen.se. Information regarding changes shall be provided on www.fullmaktskollen.se.

 

12. Winding up of fullmaktskollen.se

12.1 Fullmaktskollen i Sverige AB may wind up fullmaktskollen.se in whole or in part. In such cases, users shall be notified in ample time, not later than two months prior to winding up.
